Forensic psychiatry is a branch of psychiatry that deals with the involvement of individuals who may have mental or intellectual disorders in legal proceedings, as well as the relationship that mental illness may have with delinquent behavior and legal issues in general.

In civil proceedings, a forensic psychiatrist can evaluate whether an individual is competent to make legal decisions, such as drafting a will or engaging in any process that requires the person to have full mental and cognitive clarity in order to perform the action.

There are mental and intellectual disorders that may prevent a person from being legally competent, and such individuals may need to be placed under full or partial legal guardianship in order to protect them.

Additionally, actions and transactions carried out by a person who is in a state of mental or intellectual incapacity and is not legally competent may be annulled through legal proceedings.

In criminal proceedings, individuals with mental or intellectual disorders may sometimes be unable to understand the wrongfulness of their actions when breaking the law, and their disorder may contribute to a lack of awareness or inability to perceive the wrongfulness of their actions or to act according to their understanding of that wrongfulness.

In such cases, forensic psychiatric evaluations provide answers to the court’s questions and clarify the extent to which the mentally ill individual was accountable for the wrongful acts they were involved in.
